Licence & Terms

1. Licence

During the closed beta, CakeTax is licensed to you free of charge for evaluation and feedback, on the terms set out here. Purchasing CakeTax grants you a personal, non-exclusive, non-transferable licence to install and use CakeTax on any Mac that you own or control. The software is licensed, not sold.

2. What you may not do

You may not resell, sublicense, rent, publish or redistribute CakeTax; remove or alter its copyright notices; or attempt to derive its source code except to the extent that applicable law expressly permits despite this restriction.

3. Beta releases

Beta builds are provided free of charge, may contain defects, may change or remove features without notice, and may expire or require an update to keep working. Feedback you send us may be used to improve the product without obligation or compensation.

Beta access is granted at our discretion and may be withdrawn at any time. Beta builds may be time-limited and may stop working until updated. Participation in the beta does not grant a licence to the 1.0 release; beta testers receive a discount code at launch.

Beta builds send daily research reports as described in the privacy policy. This is what the beta is for, so it is part of taking part: the app explains it and shows you a sample report on first launch, and you are free to decline and not run the beta. Beta builds also test two different signal-filtering algorithms, switching between them on a schedule without telling you which is active, so that your feedback isn't coloured by knowing. You can leave the beta at any time by emailing us; we will delete your reports.

4. Third-party components

CakeTax includes open-source work governed by its own licence terms, reproduced on the third-party notices page. Those terms prevail over this agreement for the components they cover.

5. No warranty

CakeTax is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose or non-infringement.

CakeTax estimates proximity from Bluetooth signal strength, which is affected by walls, bodies, interference and hardware variation. It may fail to lock your Mac when you expect it to, and may lock it when you do not expect it to. It is a convenience feature and must not be relied upon as a security control.

Keep your macOS screen lock and screensaver password configured. CakeTax supplements those settings and does not replace them; do not weaken them because you have installed it. CakeTax must not be represented as satisfying any security, audit, certification or regulatory obligation.

6. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to CakeTax is limited to the amount you paid for it. We are not liable for any indirect, incidental, special or consequential damages, or for lost profits. We are also not liable, whether the loss is direct or indirect, for any loss arising from CakeTax failing to lock your Mac, locking it unexpectedly, or from unauthorised access to an unlocked Mac.

Nothing in this agreement excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Consumers may have statutory rights that this agreement does not affect.

7. Refunds

If CakeTax does not work for you, email us within 30 days of purchase and we will arrange a full refund through Lemon Squeezy, who processed the sale: hello@caketax.app.

8. Privacy

See the privacy policy. In short: the app has no accounts and no cloud service, collects nothing by default, and its only optional network features are update checks and opt-in anonymous statistics.

9. Term

This licence continues until terminated. It terminates automatically if you breach it, at which point you must stop using CakeTax and delete all copies.

10. Governing law

These terms are governed by the laws of Iceland, without affecting any mandatory consumer protections of the country you live in. Disputes are subject to the jurisdiction of the Icelandic courts, unless mandatory law gives you the right to sue at home.
